PURPOSE OF THE UNIT STANDARD 
The learner credited with this unit standard is able to explain the legislation and regulations impacting on the public service as well as the powers and composition of the public service. Learners will also be able to list and explain the various labour institutions within the public service and explain the types of disputes which may be handled by each of these institutions.

The qualifying learner is capable of:
  • Explaining the application, scope and purpose of legislation in the public service with respect to employment relations.
  • Demonstrate an understanding of the Public Service Act and Public Service Regulations.
  • Demonstrate an understanding of dispute resolution institutions and procedures in the public service.

    Explain the application, scope and purpose of legislation in the public service with respect to employment relations.

    The legislation with respect to employment relations which applies to the public service is listed giving an indication of the section number and the relevant Act in which they can be found. 

    ASSESSMENT CRITERION 2 
    A brief explanation is given of the purpose of the legislation. 

    ASSESSMENT CRITERION 3 
    The impact of the legislation is outlined in terms of employment relations in the public service. 

    ASSESSMENT CRITERION 4 
    The decision making powers of the various executing authorities are explained with examples. 

    ASSESSMENT CRITERION 5 
    The composition of the public service is outlined as set out in the Public Service Act. 

    SPECIFIC OUTCOME 2 
    Demonstrate an understanding of the Public Service Act and Public Service Regulations. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The functions and powers of the executing authorities as provided in the Public Service Act and the Public Service Regulations are listed. 
    ASSESSMENT CRITERION RANGE 
    Executing authorities may include but is not limited to Ministers, Premiers and MEC's.
     

    ASSESSMENT CRITERION 2 
    The implementation or limitation of actions affecting the public service or its members is explained as provided for in the Public Service Act. 

    ASSESSMENT CRITERION 3 
    The conflict of interest in employment acts or decisions are explained as per the Public Service Regulations. 

    ASSESSMENT CRITERION 4 
    An outline is given of the sections in the Public Service Regulations impacting on employment relations. 
    ASSESSMENT CRITERION RANGE 
    Sections impacting on employment relations in the public service Regulations may include but are not limited to:
  • The job evaluation, compensation for employees, working environment, procedures for appointment, promotions and termination of service, performance management, development training and education and labour relations provisions for senior management service.
     

  • SPECIFIC OUTCOME 3 
    Demonstrate an understanding of dispute resolution institutions and procedures in the public service.

    The various institutions, which are linked to dispute resolution in the public service are listed. 

    ASSESSMENT CRITERION 2 
    The scope of each institution is outlined with examples which determine jurisdiction. 

    ASSESSMENT CRITERION 3 
    An explanation is given of the types of disputes referred to each institution. 
    ASSESSMENT CRITERION RANGE 
    Types of disputes may include but are not limited to:
  • Unfair labour practice, mutual interest, interpretation and application of collective agreements, unfair dismissals and unilateral changes to terms and conditions of employment.
     

  • ASSESSMENT CRITERION 4 
    An explanation is given of the different procedures and processes in the various institutions. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this unit standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA or an ETQA that has a Memorandum of Understanding in place with the relevant ETQA.
  • Anyone assessing a learner against this unit standard must be registered as an assessor with the relevant ETQA or an ETQA that has a Memorandum of Understanding in place with the relevant ETQA.
