PURPOSE OF THE UNIT STANDARD 
The learner credited with this Unit Standard is able to deal with the major problem facing stable labour relations, namely large scale retrenchments by organisations. It will enable the learner to facilitate a mass retrenchment process.

The qualifying learner is capable of:
  • Demonstrating an understanding of and apply the requirements for the issuing of a notice of intention to dismiss.
  • Preparing for facilitation meetings.
  • Conducting facilitation meetings.
  • Completing the facilitation meetings. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    It is assumed that learners are competent in:
  • Communication at NQF Level 5 or equivalent. 

  • UNIT STANDARD RANGE 
    Mass (large scale) retrenchments refer to dismissals based on operational requirements by organisations with more than 50 employees. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Demonstrate an understanding of and apply the requirements for the issuing of a notice of intention to dismiss. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The requirements that have to be met and the relevant information that has to be supplied when issuing a notice of intention to dismiss are understood and examples of such notices are reviewed to assess their degree of compliance with the requirements. 
    ASSESSMENT CRITERION RANGE 
    Relevant information required may include but is not limited to:
  • Reasons, alternatives, number of employees affected, selection criteria, timing, proposed severance pay, employee assistance programme, number of employees and number of employees previously dismissed.
     

  • ASSESSMENT CRITERION 2 
    A request for a mass dismissal and for the issuing of a notice of intention to dismiss is reviewed for correctness and completeness in terms of the legal requirements. 

    ASSESSMENT CRITERION 3 
    An explanation is given of the reasons (rationale) for the formal request for facilitation for a mass retrenchment. 
    ASSESSMENT CRITERION RANGE 
    Reasons may include but are not limited to:
  • Technical, economic, structural or similar.
     

  • ASSESSMENT CRITERION 4 
    A request for the disclosure of relevant information is made to enable the parties to be in a position to consult constructively. 

    ASSESSMENT CRITERION 5 
    A notice of intention to dismiss is drawn up in compliance with relevant requirements and legislation.

    Prepare for facilitation meetings.

    The referral for facilitation is reviewed to ensure an accurate assessment and understanding of the problems.

    Parties are consulted to set up the first meeting in the facilitation process. 

    ASSESSMENT CRITERION 3 
    The importance of acting with initiative, speed and urgency are explained with examples of the consequences.

    Conduct facilitation meetings.

    The objectives of the facilitation meetings are developed and communicated to the parties. 

    ASSESSMENT CRITERION 2 
    An explanation is provided as to the purpose of the employer party preparing the framework document for discussion at the meetings. 

    ASSESSMENT CRITERION 3 
    The process to be followed at the meetings is explained in terms of its impact on the outcomes of the meetings. 

    ASSESSMENT CRITERION 4 
    Meetings are conducted in a manner that facilitates constructive exchange of information between the parties. 

    ASSESSMENT CRITERION 5 
    An explanation is given of the alternatives to retrenchment. 
    ASSESSMENT CRITERION RANGE 
    Alternatives may include but is not limited to:
  • Job retention measures, social responsibility plan, re-employment agreement, bumping, transfers and re-training.
     

  • ASSESSMENT CRITERION 6 
    Media and technology are utilised where appropriate and in ways that promotes the purpose of the meeting. 

    ASSESSMENT CRITERION 7 
    The consequences of not developing a culture of consultation and consensus during the facilitation process are explained with examples of possible outcomes.

    Complete the facilitation meetings.

    An explanation is given of the course of action to be taken once facilitation meetings are concluded. 

    ASSESSMENT CRITERION 2 
    Records of meeting decisions and outcomes are evaluated and validated as accurate, relevant and complete. 

    ASSESSMENT CRITERION 3 
    The administrative tasks are completed after the conclusion of consultation. 

    ASSESSMENT CRITERION 4 
    The process of arranging and conducting the meetings is evaluated in terms of successes and failures.

  • An individual wishing to be assessed (including through Recognition of Prior Learning) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA or an ETQA that has a Memorandum of Understanding in place with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or an ETQA that has a Memorandum of Understanding in place with the relevant ETQA.
