PURPOSE OF THE UNIT STANDARD 
The person credited with this unit standard is able to differentiate between other legislation and High Court and Magistrate's Court legislation. Learners will be able to select the method of carrying out the service in terms of the relevant legislation. Learners will also be able to define various restricted areas in terms of service and be able to follow the rules and affect these restricted areas. Further learners will also be able to process foreign documents in terms of the relevant laws.

On successful completion of this Unit Standard the learner will be able to:
  • Serve process, documents and notices in terms of other legislation.
  • Determine the channels and procedures to be followed in serving documents in restricted areas.
  • Assess the service of documents in terms of international law.

    OUTCOME RANGE 
    Other legislation refers to other legislation apart from the High Court Act and the Magistrates Court Act. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The similarities and differences between High Court and Magistrate Court legislation and other legislation are determined in order to understand the respective procedures in serving of process, documents and notices. 

    ASSESSMENT CRITERION 2 
    Methods of effecting the service is selected in terms of relevant legislation. 

    ASSESSMENT CRITERION 3 
    Service is effected in terms of relevant legislation and laws. 

    ASSESSMENT CRITERION 4 
    A return of service or non-service is rendered in terms of relevant legislation. 

    ASSESSMENT CRITERION 5 
    Costs are determined in accordance with the prescribed tariffs in the relevant legislation. 

    SPECIFIC OUTCOME 2 
    Determine the channels and procedures to be followed in serving documents in restricted areas. 
    OUTCOME RANGE 
    Restricted areas include inter alia embassies, ships, airports, military establishments, parliament and prisons.

    National laws and standards are compared with international laws and standards in order to select the appropriate process.

    The nature of foreign documents is analysed in order to explain the procedures related to international service.

    The procedures undertaken for service of documents are described according to legal and organisational requirements.

    The requirements of the document that proves service is determined in terms of applicable law.

  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard or assessing this Unit Standard must be accredited as a provider with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
