PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful to those who work or intend to work within the field of Immigration Law Enforcement, and who are required to administer the movement and sojourn of foreigners in South Africa.

People credited with this unit standard are capable of:
  • Carrying out routine checks to enforce legislation.
  • Checking on the status of permits.
  • Taking actions to address offences.

    LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already familiar with the relevant Immigration legislation and regulations.
  • Communication NQF Level 4.
  • Mathematical Literacy NQF Level 4.

    UNIT STANDARD RANGE 
    This unit standard covers activities at places of work, educational institutions, financial institutions, places of accommodation, shops, businesses, farms and informal settlements.

    Learners will be expected to work with a wide range of people, mainly in the public, as well as with the police, the South African National Defence Force, Non-Government Organisations, National Intelligence Agency and any other law enforcement agency and the business sector. The learner will also be required to interact with the Justice Department.

    References to "the relevant Act" mean:
  • The Immigration Act/Regulations.
  • Criminal Procedure Act if appointed as a Peace Officer in terms of Section 334 of the Criminal Procedure Act.

    SPECIFIC OUTCOME 1 
    Carry out routine checks to enforce legislation. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Routine checks are carried out based on a planned process and adequate sampling. 
    ASSESSMENT CRITERION RANGE 
    Routine checks refer to:
  • Investigating marriages, interviewing people, investigating complaints, obtaining information from neighbours.

    ASSESSMENT CRITERION 2 
    Routine checks are conducted in order to establish the status of those sampled. 

    ASSESSMENT CRITERION 3 
    An network of informers is maintained and monitored where possible. 

    ASSESSMENT CRITERION 4 
    Actions are taken where required to examine the status of people in terms of legislation. 
    ASSESSMENT CRITERION RANGE 
    The term actions include but are not limited to: taking fingerprints, checking and verifying place of birth, checking permits, checking records on movement control system, interview, taking statements, recording comments and findings, taking photos.
     

    ASSESSMENT CRITERION 5 
    Routine checks and related actions are conducted in order to contribute to an increased awareness among communities of the impact of illegal foreigners on society, but without contributing to increased xenophobia. 

    ASSESSMENT CRITERION 6 
    Notification is given to people in writing to appear before an Immigration Officer to answer questions or give evidence wherever warranted.

    Check on the status of permits.

    Descriptions are provided of the purpose of different types of permits with distinctions provided between the requirements of different permits.

    The validity of permits is checked in terms of the requirements and status of the permit.

    Checks are conducted in order to establish the compliance of permits with their purpose, terms and conditions.

    Checks are undertaken routinely to establish whether employers, institutions and other entities uphold their obligations in terms of permits for foreigners.

    Take actions to address offences.

    Illegal foreigners are informed of intended adverse actions to be taken against them, as well as their rights in terms of the SA Constitution. 

    ASSESSMENT CRITERION 2 
    Illegal foreigners are ordered to depart or are detained with a view to deport them, as required by the situation, in line with legislation. 

    ASSESSMENT CRITERION 3 
    Appeals procedures are processed and facilitated, in terms of regulations and the provisions of the Immigration Act. 

    ASSESSMENT CRITERION 4 
    Actions are taken in order to contribute to prosecutions and the reduction of illegal foreigners. 

    ASSESSMENT CRITERION 5 
    Documentation is completed and stored in order to ensure that it is valid, accurate and up to date.

  • Records, search warrants, investigation diary and notice of decisions.

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a candidate against this unit standard must be registered as an assessor with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider through the relevant ETQA by SAQA.
  • Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines and the agreed ETQA procedures.

  • Ways in which locals, particularly the dispossessed and poverty stricken, are exploited by illegal foreigners in this respect.
